This Data Processing Policy may be changed or updated at any time by Partymaker 2 s.r.o. when we consider that certain changes have occurred in the activities through which we process your data.
We will publish any such changes.
WHO ARE WE?
Partymaker 2 s.r.o., with its registered office at Rajská 3, 811 08 Bratislava, registered in the Commercial Register under number 47870125 (ID No.) and Commercial Register entry number 100527/B (“Partymaker 2 s.r.o.” or “Operator” or “We”), is the operator of your data and the entity that provides you with power banks at various locations in your city through the BatteryBox application. What is personal data?
Personal data means any data or information that helps us identify you directly (e.g., your first and last name) or indirectly (e.g., based on a profile we create to send you personalized offers). Some information is less obvious (e.g., your shopping preferences and habits, your device's IP address), but in connection with you, it helps us identify you and therefore falls under the term "personal data." Partymaker 2 s.r.o.'s policy is to collect and process only the data we need to provide you with the most enjoyable experience when browsing/shopping in the BatteryBox app. In general, we process the following types of data about you:
- First and last name;
- Email address;
- Phone number;
- General geolocation of the device from which you are authentically logging into your customer account;
- Information about purchased products and services;
- Your use and activities on the site; Specifically, in the table below, we have listed the personal data ("Data" or "Personal Data") that we collect directly from you, that results from your interaction, and that we or our partners track in order to provide you with the products/services you have ordered or to offer you various personalized offers when browsing/shopping on the website or when using various devices (tablet or mobile phone).
HOW DO WE PROCESS YOUR DATA?
Partymaker 2 s.r.o. collects and processes your data to fulfill orders you place, to improve your experience with the BatteryBox app, to provide help and support when using the BatteryBox app/customer account, or to create a customer profile for the purpose of sending personalized offers (direct marketing). In the table below, we have detailed how we process your data, the purposes and legal basis (legal basis) of the activities through which we process your data.

Creating your customer account: We can create a customer account for you in the BatteryBox application only if you provide us with the following personal data, either (a) during the process of your request to open a new customer account, or (b) as a result of placing an order for the first time in the BatteryBox application (and we will activate your customer account on this occasion so that we can fulfill your order): First and last name; Email and phone number.
Shopping in the BatteryBox app: You can only make purchases if you have an activated customer account, add some products to your shopping cart, and then place an order. You can make purchases in the BatteryBox app, which means you accept the Terms and Conditions of the app in advance.
Contract fulfillment: To fulfill your orders, deliver products to pickup locations, and perform our product warranties.
For each order, we will collect and process the following data: first and last name; telephone number.
Payment for purchases / refunds in case of product returns/order cancellations: The details of the card you use for Stripe payments for purchases in the BatteryBox app will not be accessible or stored by Partymaker 2 s.r.o., but only by the entity authorizing the transaction or another entity authorized to provide card data storage services, whose identity will be disclosed to you before the actual transaction .r.o., but only by the entity authorizing the transaction or another entity authorized to provide card data storage services, the identity of which will be disclosed to you before you actually enter the details of the card you use for online payments.
Contract completion: To ensure the necessary support in processing by our partners authorized to mediate payment for the products you have ordered.
[Stripe is a security measure that involves redirecting the customer at the time of payment to a secure page where each cardholder is registered by assigning an authorization code for each online transaction. Accepted payment cards are those issued under the VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV/CV2 code) logos].
- Partymaker 2 s.r.o. only processes the following data, which it sends to its partner for online payments/authorization partnership: first name, last name; order ID; transaction start date, completion date; transaction ID; payment status (payment made/not made); transaction amount (if relevant). – In the event of a return/cancellation of an order, we collect and process: IBAN and the bank where you opened your bank account, in order to refund your payments for returned products/services/cancelled orders.
Customer support and assistance: In order to provide you with support regarding your customer account/orders placed on the website, we identify you by confirming: your first and last name; your email address and phone number; – With your prior consent, we may process your voice from recordings of telephone conversations with you in order to respond to your requests for assistance. – We will also process the same data for the purpose of resolving complaints.
Completion of the contract: Fulfilment of our obligations/activities during the contract period.
Loyalty promotions: Partymaker 2 s.r.o. assigns and provides various discounts and benefits related to our loyalty promotions (in the form of vouchers, discounts, etc.).
Contract performance: For the purpose of carrying out our loyalty campaigns and offering commercial discounts in relation to you.
Promotional campaigns, contests, events, or competitions: We collect your email address for online contests organized in the BatteryBox app. We also organize contests on the official BatteryBox Facebook/Instagram page, where, depending on the campaign, we collect the following data necessary to participate in the contest, or we identify you by confirming your customer account/orders placed on the site: your first and last name; your email address and phone number. – With your prior consent, we may process your voice from recordings of telephone conversations with you in order to respond to your requests for assistance. We will also process the same data for complaint resolution.
Consent: For the purpose of your participation in competitions organized by Partymaker 2 s.r.o. and for the awarding of relevant prizes. Fulfillment of our obligations/activities during the term of the contract.
Loyalty promotions: Partymaker 2 s.r.o. assigns and provides various discounts and benefits related to our loyalty promotions (in the form of vouchers, discounts, etc.).
Contract fulfillment: For the purpose of carrying out our loyalty campaigns and offering commercial discounts in relation to you.
Promotional campaigns, contests, events, or competitions: We collect your email address for online contests organized in the BatteryBox app. We also organize contests on the official BatteryBox Facebook/Instagram page, where we collect the following data necessary to participate in the contest, depending on the campaign: operating system of the device; o HTTP/HTTPS log data; o The length of your visit/activity in the app; o The general location of the device (if geolocation is enabled) from which you connect to the app. [Please note that most devices allow you to disable geolocation services directly in the device settings]. ["Cookies" – files that the server sends to your device when you download/use the mobile application. The purpose and manner in which we process cookies are described in detail in the cookie policy available in the mobile application.]
Online behavioral advertising: Based on your navigation and behavior in the mobile app, monitored by cookies, we will provide you with online advertisements for some of our products/services that may be of interest to you. Based on information about your browsing in the mobile application, we will place you in an interest group with other similar customers, such as browsing behavior, and thus deliver advertisements (banners) based on these interests. For example, your data may be used to derive an interest profile of "books" by evaluating the products you have visited in the mobile app, and in this way a cookie is placed on your device that classifies you as someone interested in the "books" category, and you will later receive specially personalized advertising messages from the "books" category.
Cookie consent: Cookies that monitor your behavior on the website. If you do not wish to participate in cookie monitoring for the purpose of sending online advertisements (banners) based on your interests, you can refuse the cookie setting by setting your browser to generally disable the automatic setting of cookies. You can also disable cookies for the advertising services of your browser provider (e.g., Google) by setting your browser to block cookies from the relevant domain. Opting out of online behavioral advertising will not stop the display of general advertisements that are not personalized to your interests.
Auctions based on your own target groups (based on customer lists): With your consent, we will use your email address and mobile phone number to create encrypted customer lists ("hash data"), and then use the encrypted data from this list to match your (and other customers') interest group data to the data of individuals on Facebook/InstagramInstagram to send personalized offers through targeted ads on this channel, on your Facebook/Instagram account. Facebook/Instagram encodes the hash data, uploads it to the social platform, and in this way we build an audience using this hash data solely to correlate with your Facebook/Instagram account data, without sharing this data with third parties (or other commercial advertising agencies), and it will be automatically deleted by Facebook/Instagram immediately after correlation.
Consent: To send personalized offers on Facebook (using Custom Audiences based on customer lists). For more information about the purposes, methods of collection and processing of personal data by Facebook, and your privacy settings on Facebook/Instagram, please refer to Facebook's Privacy Policy in the Ad Help Center.
Maintenance and security of the Mobile Application website: We use the following online identifiers to maintain and secure the Online Store website: o IP address; o Internet browser you use and the version of the operating system of the device you use to connect; o HTTP/HTTPS protocol data; o Location of the device (if geolocation is enabled) from which you connect to the mobile application.
Specifically, we process your data for:
- Ensuring the proper functioning of the application, i.e.: o Correct display of the mobile application content; o Storage of your login details (when you request us to do so); o Improvement of the mobile application; o Parameterization of the device from which you connect/authenticate according to the requirements of the mobile application. – Ensuring the security of the website and protecting against fraud or any breach of IT security in connection with the BatteryBox application. – Identifying and eliminating malfunctions that prevent the use of our application or your customer account.
Legitimate interest: Implementation, parameterization, and maintenance of security measures for the BatteryBox mobile application.
Auditing and reporting: We process your data for the annual financial audit, as well as for the submission of tax and accounting reports to the relevant tax authorities.
Legal requirements: To comply with legal obligations arising from applicable laws and regulations in the area of tax and accounting matters.
Protection/legal rights: When we defend our rights in court in the recovery of amounts owed, or when we protect our interests against unjustified claims/complaints, we will process your data necessary for the formulation of objections, written conclusions, requests, and specific documents.
Legitimate interest: Exercising any defenses/rights before courts or public/supervisory authorities or institutions.
Proceedings and investigations by authorities and/or courts: Exceptionally and in accordance with the law, we will provide the relevant authorities and institutions with your following data as part of proceedings/investigations, normal or other steps stipulated by law: name, surname, address, email, telephone number. Partymaker 2 s.r.o. will document any such actions.
Legal requirements: To comply with specific legal obligations arising from applicable laws in the area of fraud prevention, money laundering, and terrorism.
Data we collect from other sources
Browsing social networks: If you like/follow us on the Facebook/Instagram page of Partymaker 2 s.r.o.
Consent: Sending personalized offers on Facebook (using the Custom Audiences service based on customer lists).
PROFILING FOR DIRECT MARKETING PURPOSES
When we send you personalized offers through direct marketing channels (SMS, email, push notifications), we may use certain "profiling techniques," specifically the automatic processing of your data, which consists primarily of analyzing and interpreting your personal data to evaluate or predict certain aspects of your preferences and interests when shopping in the BatteryBox app. For profiling purposes, Partymaker 2 s.r.o. does not process sensitive data relating to sexual orientation, religious beliefs, or political opinions. Your personal shopping behavior and preferences are derived from your history of visits and/or purchases in the BatteryBox app, your mobile app user data, your financial situation as reflected in your purchases, and other personal interests you have provided to us, as well as interests shared with other customers. Specifically, Partymaker 2 s.r.o. creates your customer profile as follows:
- based on your browsing activity on the website, products viewed, products added to the shopping cart;
- based on demographic data: age, city;
- based on your purchase history and monetary value. We collect your data for profiling from sources such as: our website https://batterybox.sk and advertising service providers with whom we collaborate.
We use profiling to communicate and present personalized promotional offers in a way that is relevant and useful to you.
We will be able to provide you with the option to change your marketing preferences directly in your customer account at https://batterybox.sk at any time after registering as a customer of Partymaker 2 s.r.o. by selecting this option in your customer account.
You may object to profiling for direct marketing purposes on any communication channel to which you have previously consented by withdrawing your consent to unsubscribe from the specific communication channel to which you have previously subscribed. For more details, see “Your rights and options” below.
HOW LONG DO WE STORE YOUR DATA?
Partymaker 2 s.r.o. processes your data for the period necessary to fulfill the purposes for which it was collected and in accordance with our personal data retention policies. In some cases, certain laws may require or allow the retention of data for a longer period.
The data retention period depends primarily on the following factors:
- for how long we need your data to provide the requested products and fulfill our obligations to you and for the purposes set out above in this policy;
- whether you have an open customer account in the mobile app.
- In this case, we will retain your data for as long as this customer account is active, but no longer than 5 (five) years from the date of your last login to the account or your last order in the BatteryBox application (without logging into the account); we will notify you before closing your customer account and deleting all data associated with that customer account;
- if you have given your consent to the processing of data for a longer period, we will store the data for the entire period, unless you revoke your consent in the meantime;
- Legal or contractual obligations require us to retain your data for a certain period of time (e.g., statutory periods for defending our rights in court). We will only retain your data for as long as you have a customer account and/or continue to make purchases in the BatteryBox app. If you deactivate your customer account in the BatteryBox app and expressly request us to delete it completely, the data associated with your customer account will be deleted or anonymized so that you can no longer be identified in our data systems, unless we are required by law or our legitimate interest to retain your data for a longer period. This way, we give you complete control over your personal data.
We will collect and process your data again if you provide it to us again in the mobile app.
For the purposes for which you have given us consent to process your data, as indicated in the table above, we will process your data in connection with this purpose until you withdraw your consent to processing for this purpose, unless we are required by law to retain this data for a longer period for the purposes of reporting to public authorities or defending our rights in court. Please note that we rely on your consent when we process your data for sending:
- personalized offers based on online behavioral advertising;
- personalized offers based on profiling, which we do for direct marketing purposes, through communication channels such as SMS, email, and push notifications;
- offers based on customized target groups (customer lists) on Facebook/Instagram. *Consent – means your free, specific, and informed consent, by which you unambiguously accept the processing of your data by our company for the purpose for which you have given your consent.
Who do we share your data with?
Your personal data may be transferred and processed by our trusted partners for the purpose of providing products. In order to provide you with the products you have ordered in the BatteryBox app, we share your data with our trusted partners. We carefully select partners and suppliers who perform operations on our behalf and support our activities. We only share with them the personal data necessary to perform the specific activities we entrust to them. When we transfer certain activities to our trusted partners, we make every reasonable effort to ensure that they protect your data with strict data security measures, and we enter into data processing agreements with each of them. More specifically,
- the supplier who provides us with data storage services on external servers,
- provider of communication and e-mail transmission services,
- mobile phone service provider, which helps us keep in touch with you,
- Payment processors that we have authorized to process payments in the Stripe system.
Transfer of data to authorities and public institutions or judicial authorities We may transfer some of your personal data to relevant authorities or public institutions when required by law (e.g., fraud investigation; prevention of money laundering; submission of tax returns, financial reports to tax authorities, etc.), or we may transfer such data to judicial authorities in defense before a court or other public authorities.
Access by auditors and consultants If we decide to transfer the shares or business of Partymaker 2 s.r.o. in the future, we will provide access to or transfer our clients' data to the auditors and consultants of potential buyers in order to perform the audit necessary for the purchase of shares/business. For this purpose, we will ensure that the potential buyer complies with and implements the necessary security measures to protect your data, and the parties will enter into a data processing agreement in advance for the purpose of the transaction.
WHEN DO WE TRANSFER YOUR DATA OUTSIDE THE EUROPEAN UNION OR THE EEA?
Your data is not usually stored in a country outside the European Union or the European Economic Area ("EEA"). If we transfer your data to other partners/suppliers of Partymaker 2 s.r.o. located in countries that do not provide an adequate level of protection for the transferred data, we undertake to take all necessary measures to ensure that the relevant partners/suppliers comply with the conditions set out in this policy. These measures may additionally include the implementation of data protection standards (e.g., ISO 27001), standard contractual clauses adopted by the European Commission, as well as a direct control system for these mechanisms.
HOW DO WE KEEP YOUR DATA SAFE?
Partymaker 2 s.r.o. provides the technical and organizational measures necessary for the collection, processing, and secure storage of data, including protection against unauthorized access, unauthorized use of data, or destruction, loss, or alteration of data. We are committed to ensuring the security of your personal data and take all reasonable measures to protect it. We implement system processes to train those responsible for IT security and to monitor and audit the security of IT systems and infrastructure in accordance with Partymaker 2 s.r.o.'s internal policies. In addition, we make every reasonable effort to ensure (including through contracts with them) that our trusted partners also manage appropriate technical and organizational measures for the processing of data that we share with them.
What rights and options do you have regarding your data?
We want to ensure that you always have complete control over your data and that you can effectively exercise your rights and options under the GDPR. To ensure that you have effective control over your data, we inform you that you have the following options based on available technologies:
- you can manage direct access, correction, or deletion of certain data available in your customer account in the BatteryBox application;
- Social media platforms and search engines (e.g., Google or Facebook) provide you with the ability to manage various options regarding how you wish your data to be processed.
In addition to these options, the GDPR gives you, as a data subject, the rights described below. Before fulfilling any request regarding your rights, we will ensure that you are the owner of the data to which you decide to apply these rights, and for this purpose we may request certain information/data to verify your identity, or we may request more details about your request. We may keep a record of the correspondence we have with you so that we can keep track of your rights requests and responses.
Right to information You have the right to clear, transparent, easily understandable, and easily accessible information about how we process your data, including details about your rights as a data subject. This information about the data, purpose, and methods of processing your data is also included in this policy.
Right to access data You have the right to access the data we process about you, without any charge for the first delivery of data.
If you request copies of data that has already been provided, we may charge a reasonable fee to cover the administrative costs of providing the data. Right to correct data If you find that the data we process about you is incorrect, incomplete, or inaccurate, you can send us a request for correction to the email address support@batterybox.sk.
Right to object to direct marketing (including profiling for direct marketing purposes) You can always object to and unsubscribe from our direct marketing communications at any time. You can easily do this by clicking on the "unsubscribe" link in any email we send you or from your account in the "Account Settings" section. In addition, you can revoke your previously expressed consent to receive personalized offers based on profiling through the same channels through which we communicate these offers to you, namely: email, SMS, or push notifications.
Withdrawal of consent (by unsubscribing or written request) does not affect the lawfulness of processing based on consent before its withdrawal.
Right to object to processing based on legitimate interest You may object to the processing of your data at any time if such processing is based on our legitimate interest.

Right to erasure (right to be forgotten) You have the right to ask us to erase your data in one of the following situations: a) the personal data is no longer necessary for the purposes for which we previously processed it; b) you withdraw your consent on which we processed your data and there is no other legal basis on which we could base future processing; c) you object to the processing of data when we process data for direct marketing purposes (including profiling for direct marketing purposes); d) you object to the processing of data based on our legitimate interests and we cannot demonstrate that we have legitimate reasons that justify the processing and that outweigh your interests, rights, and freedoms; e) personal data is processed in violation of the law; f) the personal data must be erased to comply with our legal obligations.
This right is not absolute. We may refuse your request to delete data if: (i) we are required to comply with legal obligations to retain the data; or (ii) the data is necessary for us to establish, exercise, or defend our legal claims.

Right to Restrict Processing You have the right to obtain from us restriction of processing in one of the following situations.
(a) the accuracy of the data is disputed by you (the data subject) for a period that allows us to verify the accuracy of the data;
(b) the processing of the data is unlawful and you (the data subject) oppose the erasure of the data and request that we restrict the processing of such data;
(c) we no longer need the data, but it is required by you (the data subject) for the establishment, exercise, or defense of legal claims;
(d) you (the data subject) object to the processing of data based on our legitimate interests, based on verification that the legitimate reasons of the controller outweigh your interests, rights, and freedoms.

Right to data portability When we process your data based on consent or contract performance, and automatically, you will have the right to request the transfer of your data:
(a) to you or (b) to another controller designated by you. The second situation assumes that you have the option to request that we transfer data related to your customer account to another data controller (e.g., a controller that manages another online store). More specifically, you will be able to request the transfer of personal data only from those that you have provided to us directly and actively (excluding any data created or developed by XYZ, such as a customer profile). You can exercise this right by sending a written request to the email address: support@batterybox.sk. We will transfer your requested data, as specified here, in a structured and reusable data format (e.g., XML, JSON, CSV format).
Right to lodge complaints with a supervisory authority You have the right to lodge any complaints with the National Supervisory Authority for Personal Data Protection (“ANSPDCP”) regarding how we process your personal data. However, we hope that you will choose to talk to us first before lodging any complaints with ANSPDCP.
The protection of your data is very important to us, and we will take all necessary measures to address any issues relating to the control and security of your data.
You can also address various questions to ANSPDCP, the supervisory authority for data protection in Slovakia.
